I posed this question recently to Mark Johnson, a tax strategy consultant with America Tax Solvers who specializes in home care agencies.
According to Mark, there's a pretty simple answer: you should be an LLC until such time as you're ready to pay yourself a managerial salary of $70,000 or more, at which point you should move to S-Corp.
A lot of financial gurus and "influencers" on Facebook or Tik Tok will tell you to start as an S-Corp from the beginning. Mark says this is simply because it sounds counterintuitive ("sexy" was the word he used, a word you don't often here used in conversations about taxes) and therefore makes people feel like they're getting in on a secret. So while it's an appealing message for a financial influencer trying to build an audience, it's rarely good advice for home care agencies.
Breaking it down: A key difference is that an S-Corp requires you to pay yourself a salary and is designed to produce tax savings for an owner earning a salary (as opposed to other forms of compensation).
However, bear in mind that 1) most home care owners don't pay themselves for a while, often more than a year, until the agencies are turning a strong profit, and 2) the math for the tax benefits of an S-Corp don't really start to work in your favor until your salary is at least $70-100k.
